The following booking agreement is between The Rich Gordon Music Company - and the client, hereby defined as the person who engages the services of The Rich Gordon Music Company, who is the main contact for the engagement and is the signatory of this agreement. Definition of terms Force majeure is hereby defined as an event that is completely outwith the control of either party that makes honouring the booking agreement impossible. Engagement, booking and performance pertain to the employment of The Rich Gordon Music Company to perform at an event. Equipment is defined as the Highland Bagpipe or Scottish Smallpipes, the alto saxophone, the tenor saxophone and any other audio amplification equipment The Rich Gordon Music Company requires to perform with. Outfit is defined as the clothing worn by Rich Gordon performing in any capacity that is specific to the performance. 1.Deposit and booking confirmation Bookings made with more than 30 days until the engagement remaining. You will be given a 7-day first refusal on a given date, during which time a deposit is required to confirm booking. To confirm booking for your event, a 25% non-refundable deposit of the total cost is required . Your booking will only be confirmed upon receipt of this deposit. The deposit must be paid within 7 days of booking otherwise the date will be made available to other customers. Bookings made within 30 days of the engagement You will be given a 7-day first refusal on a given date, during which time a deposit is required to confirm booking. To confirm booking for your event, I will require a 50% non-refundable deposit of the total cost. Your booking will only be confirmed upon receipt of this deposit. The deposit must be paid within 7 days of booking otherwise the date will be made available to other customers. Bookings made within 7 days of the engagement A 75% non-refundable deposit will be required for all bookings made within 7 days of the event. This deposit will be required within 24 hours of initial enquiry. Travel surcharges All booking options include 100 miles' total travel from Dundee. Additional mileage is surcharged at £5 per 50 extra miles. Details of this will be confirmed by Rich at the time of booking. 2. Balance 50% of the outstanding balance will due by 90 days of your event. You will receive an invoice from The Rich Gordon Music Company for this amount. The remaining 50% will be due between 7 days before and the day of the event. All outstanding balance can be paid electronically or by cash. No cheques will be accepted. Details of this will be provided in all invoices. 3. Cancellations Cancellations must be made in writing to Rich Gordon, by email. Cancellations will be subject to certain fees: More than 90 days prior to event: 25% of total outstanding contracted booking fee (excluding travel surcharge) 31-89 days prior to event: 50% of total outstanding contracted booking fee (excluding travel surcharge) 8 – 30 days prior to event: 75% of total outstanding contracted booking fee (excluding travel surcharge) 7 days or less prior to event: 100% of total outstanding contracted booking fee (excluding travel surcharge) Except in the event of force majeure, all cancellations must be communicated to The Rich Gordon Music Company with at least 24 hours' notice. No refund of booking fees will be given in the event of force majeure on the part of the client leading to a cancellation. In the event of force majeure on the part of the client that leads to the engagement being cancelled, The Rich Gordon Music Company will to try to accommodate a rescheduled appointment at a later date. This will be subject to availability, and potentially subject to additional travel surcharge, if cancellation of the engagement occurs after The Rich Gordon Music Company has arrived at the engagement venue. Where a cancellation occurs and the accumulated balance received by The Rich Gordon Music Company is below the required amount in respect to the cancellation fee of that given notice period, an invoice will be sent to the client to recoup the necessary outstanding balance due. 4. General terms of performance The Rich Gordon Music Company will operate within the following terms of employment: The client ensures that permissions are in place for the sound level generated by the various instruments and that any complaints arising are the client's responsibility. No performances will take place in locations that are deemed unsafe to person or equipment or outfit. Performances in extreme weather - i.e. freezing conditions, prolonged rain or exceptionally warm temperatures - will be conducted entirely as required by The Rich Gordon Music Company and breaks where necessary will be taken. No responsibility will be taken for discomfort experienced by guests/attendees with regards to bagpipe performance. Highland Bagpipes are loud and produce 110dB of sound. The Rich Gordon Music Company agrees to perform within a venue's audio limits if such exists, when using amplification. The Rich Gordon Music Company has a current Public Liability Insurance policy and will provide details of this upon request. The Rich Gordon Music Company will perform the tasks mutually agreed with the client as per conditions of section 5. Particular Arrangements. The Rich Gordon Music Company reserves the right to refuse to undertake any requests made that fall out with the conditions of the respective section of these terms and conditions. In the event that Rich Gordon - Piper is unable to honour an engagement through ill health or force majeure, all efforts will be made on the part of Rich Gordon - Piper to source a replacement performer, at the mutual agreement of The Rich Gordon Music Company and the client. In the unlikely event that no alternative can be located, The Rich Gordon Music Company will provide a 100% refund to the client of all associated booking fees. In the case of all bookings, should the client decide at the time of the engagement that The Rich Gordon Music Company is not required for the full time period initially booked, no refund of money will be provided to the client. 5. Particular Arrangements A. All bookings The client agrees that all timings and arrangements for the respective booking will be confirmed and communicated to The Rich Gordon Music Company by 7 days prior to the event, and that any changes within a 7-day period will be notified to The Rich Gordon Music Company as soon as they are known. In the eventuality that a booking takes place within 7 days of the event, the client agrees that all timings must be confirmed within 24 hours of the booking confirmation. The client agrees that provision of a contact phone number will be supplied to The Rich Gordon Music Company within at least 7 days in advance of the event for emergency contact purposes. The client agrees that any special requests for the performance of any music must be supplied within 28 days of the booking date, to allow time for The Rich Gordon Music Company to prepare any new material, if applicable. Failure to do so will result in an inability to accommodate such requests. For bookings that are made with less than 28 days until the event, it may not be possible to accommodate any such tune requests, and agreement to undertake any requests within this time period will be at the sole discretion of Rich Gordon - Piper. B. Weddings The client agrees that specific timings of the wedding, i.e. ceremony commencement, guests' arrival, arrival at a second venue (if applicable) will be communicated to Rich Gordon - Piper with at least 7 days' notice, and any changes to these arrangements must be communicated as soon as they are known. With regard to weddings taking place in a church or other religious building, the client agrees that if performance of the bagpipe is required inside the building, it will be the responsibility of the client to seek appropriate permissions from the officiant or administrator of the building for the bagpipe to be performed inside. If the client decides during the engagement that The Rich Gordon Music Company is required to perform beyond the agreed time period of the booking, this will be subject to an additional charge of £30 per hour with a minimum of 1 hour's charge for bagpipes only, and £40 per hour for both bagpipes and saxophone, and will be at the sole discretion of The Rich Gordon Music Company. If an engagement runs late for any reason, The Rich Gordon Music Company cannot guarantee to stay longer at the event than initially booked. In the highly unlikely event that a wedding is cancelled on the scheduled day due to a change of heart on the part of the bride(s) or groom(s), full payment will still be required and no refund will be given. C. Private and corporate engagements The client agrees that the booking fee for an engagement will be based on a pre-determined time period. If The Rich Gordon Music Company is required or requested to perform longer than initially agreed (whether through a change of mind on the part of the client or through a delay in proceedings) this will result in an additional charge of £30 per hour for bagpipes only and £40 per hour for bagpipes and saxophone at a minimum of 1 hour's charge. If an engagement runs late for any reason, The Rich Gordon Music Company cannot guarantee to stay longer at the event than initially booked. The client agrees that if The Rich Gordon Music Company is required or requested to perform beyond the originally agreed time period of the engagement, the decision to do so will be at the sole discretion of The Rich Gordon Music Company.
